Qualifying period Empty

Hi, great forum!

My wife had a 90 days/6 month Schengen visa from 1/8 2005 - 1/2 2006. She used 51 of these days, last visit in Sweden was 20/1.
According to the Swedish consulate in Istanbul it is not possible to get a second Schengen 90 days/6 month visa valid from 22/3. She will only get the remaining 39 days (90-51).
After the last trip (which will be in June) she has to wait 3 months before any new Visa can be granted. Is this really in accordance with the Schengen rules? I never heard anything about qualifying periods, just that its maximum 90 days in 6 months period from the first entry. Whats your oppinion about this?

Best Regards,

Per

Hello,

Your wife may apply for a new Schengen visa as soon as her current one will have expired. There is no such thing as a qualifying period.

If your wife has not used the 90 days granted by her current visa, the remaining days will be lost at the expiration of the visa. But immediately thereafter she may apply for a new one.

Regards.

Thanks for your reply.

This is what I always though too, but unfortunately the Swedish Consulate in Istanbul has a different opinion. I have also asked a man at Migrationsverket in Sweden which is the authority handling immigration etc. He said the consulate is following the rules! I have also found texts on Migrationsverkets webpages indicating they actually think these ARE the rules! I don't know what to believe. Will mail Migrationsverket and maybe visit them until they can show me where I can find these rules.... Anyway, a different question:
I have read at many places on internet (among them at the Finnish parlaments homepage) that a one-year/90 day Schengen visa actually entitles to 90 days/half year, so its really possible to stay 180 days within one year. Is this true?

Best Regards,

Hello,

It is possible to stay 180 days per year : 90 days/semester 1 + 90 days/semester 2.

You may apply for a Schengen visa that is valid 1 year (the maximum being 5 years). This is called a "travel visa".

Regards.
